Step 1: Verify Applicant, Employer, and Job Offer Eligibility

Before taking any formal steps, candidates and employers must confirm that all baseline eligibility requirements are fully satisfied.

  1. Applicant Criteria

Requirements vary depending on your target category:

    • TEER 0 to 3 Occupations: Most applicants need at least 2 years of cumulative, full-time work experience in the same National Occupational Classification (NOC) within the past 5 years. Current employees need 6 months of consecutive full-time experience in the exact offered position within the past 12 months, while recent Ontario graduates need 3 months. Standard education requires a Canadian post-secondary degree/diploma or a foreign equivalent with an Educational Credential Assessment (ECA) less than five years old. Language requirements generally demand a minimum Canadian Language Benchmark (CLB) level 6 (or CLB 5 for specified trades).
    • TEER 4 and 5 Occupations: Requires at least 9 months of cumulative, full-time work experience in the past 2 years specifically in the same position and with the exact same employer named in the offer. Applicants must hold a high school diploma (Canadian or ECA verified) and achieve at least CLB 4 across all language abilities.
    • Self-Employed Physicians: Bypasses employer requirements. Requires holding an independent-practice, academic-practice, or provisional certificate of registration and active membership in good standing with the College of Physicians and Surgeons of Ontario (CPSO).
 
  1. Employer Criteria

The employer must have a physical place of business in Ontario, maintain active business operations for at least 3 years, and have no outstanding orders under the Employment Standards Act or Occupational Health and Safety Act. Financial and staffing thresholds apply based on location:

      • Greater Toronto Area (GTA): Minimum $1,000,000 in gross annual revenue and 5 full-time Canadian citizen or permanent resident employees at the location.
      • Listed Census Divisions: Minimum $500,000 in gross annual revenue and 3 full-time Canadian citizen or permanent resident employees.
      • Other Areas: Minimum $250,000 in gross annual revenue in each of the two most recent fiscal years and 3 full-time Canadian citizen or permanent resident employees.
 
  1. Job Offer Criteria

The job offer must be full-time, indeterminate, primarily based in Ontario, and urgently necessary to the business. The wage must meet or exceed the regional median wage for the occupation (unless qualifying under the recent graduate exception where the low wage may apply).

Step 2: Prepare Supporting Documentation and Maximize EOI Points

Because the OINP operates on an Expression of Interest (EOI) ranking system, profile optimization is key. Before creating a profile, ensure all documentation is current:

  • Language Testing: Approved language test results must be less than two years old. Scoring a CLB 9 or higher across all four skills yields maximum points.

  • Applicant Deadline (17 Days): The candidate has exactly 17 calendar days from the ITA date to submit their full provincial nomination application.

Important Note: The applicant cannot formally submit their application until the employer completes and submits the position-approval application. Because both deadlines countdown simultaneously from the same ITA date, pre-preparing corporate and personal documents prior to entering the EOI pool is mandatory.

Step 5: Post-Nomination and Applying for Permanent Residence

Once the OINP approves both the position and the applicant, a Provincial Nomination Certificate is issued.

  • Express Entry Stream Applicants: Candidates qualifying under TEER 0 to 3 or as self-employed physicians who maintain an active federal Express Entry profile can accept the nomination to receive an additional 600 Comprehensive Ranking System (CRS) points, virtually guaranteeing an invitation for permanent residence.
  • Base Stream Applicants (TEER 4 & 5): Candidates receive a base nomination and must submit a non-Express Entry application for permanent residence directly to IRCC.

In all cases, applicants inside Canada must maintain valid temporary resident status throughout the process. Immigration, Refugees and Citizenship Canada (IRCC) retains sole authority over final permanent residence approvals.
