Work Permits for Sponsored Spouses: What You Need to Know in 2025

If you are sponsoring your spouse or common-law partner from inside Canada, one of the most important benefits available is the opportunity to apply for an open work permit while the permanent residence application is in process. This can help couples avoid financial stress, maintain stability, and build a life together while waiting for a decision.

Here is what you need to know about spousal open work permits in 2025.

Who Is Eligible for a Spousal Open Work Permit

To be eligible, the sponsored person must meet the following conditions:

  • They are being sponsored under the Family Class as a spouse or common law partner (also known as the “outland” stream), or the in-Canada spousal or common-law partner class (also known as the “inland” stream)
  • They have valid temporary resident status in Canada as a visitor, student, or worker
  • They live at the same address as the sponsor
  • The sponsor is a Canadian citizen or permanent resident who meets the eligibility criteria to sponsor
  • A complete sponsorship and permanent residence application has been submitted or is being submitted at the same time as the work permit application

How to Apply

Applicants can submit the open work permit application:

  • Online through their IRCC secure account, either at the same time as the permanent residence application or afterward
  • In some cases on paper, although this takes longer and is less commonly used

The work permit application should be supported by proof that a spousal sponsorship application has been submitted. If the applications are submitted together, IRCC will typically begin processing the work permit once the sponsorship application has been confirmed as complete.

Processing Time

As of 2025, the average processing time for spousal open work permits is approximately 3 to 4 months from the time of submission. However, processing times may vary depending on IRCC’s workload and the completeness of the application.

Validity Period

A spousal open work permit is usually issued for the same length of time as the temporary resident status or until a decision is made on the permanent residence application. Extensions are available if needed, provided the applicant remains eligible.

What You Can Do with an Open Work Permit

An open work permit allows the sponsored spouse or partner to work for any employer in Canada and in any occupation, with few exceptions. This is different from an employer-specific (closed) work permit, which restricts the worker to a particular job and employer.

What If the Sponsored Person Is Out of Status?

In some cases, a spouse who has lost temporary resident status may still apply for permanent residence and a work permit under the inland stream, through IRCC’s public policy for out-of-status spouses. However, you must wait until the application has been approved in principle. These cases require careful handling and should be discussed with an immigration professional.

Why This Matters

Allowing spouses to work while waiting for permanent residence approval is a key part of helping families stay together and thrive. The ability to work can also improve financial security, speed up integration into Canadian society, and reduce dependence on one income.
